Description of SMS Use Cases
Brightstocking, LLC uses SMS and MMS messaging to send appointment reminders, scheduling confirmations, project updates, account notifications, and, with your separate consent, promotional offers, program announcements, and educational content related to our services.

Opt-Out Instructions
You can cancel the SMS service at any time. Text STOP to the phone number from which you received the message. After you send STOP, we will send you a confirmation text. You will no longer receive SMS messages from us unless you re-subscribe.

Service Agreements

All client engagements require a signed service agreement or statement of work that outlines the specific scope, deliverables, timeline, and payment terms for your organization. These Terms apply in addition to your signed agreement. If there is a conflict, the signed agreement controls.

Payment Terms

Payment terms are outlined in your signed service agreement. Unless otherwise stated, invoices are due within 30 days of receipt. Late payments may result in a pause of work until the account is current. We accept payment by credit card, ACH, or check.

Intellectual Property

Upon full payment, you own the final deliverables created for your organization, including logos, brand assets, templates, and website copy. Brightstocking, LLC retains the right to display completed work in our portfolio unless you request otherwise in writing. We retain ownership of our proprietary processes, frameworks, and methodologies.

Your Responsibilities

You agree to provide timely feedback, approvals, and access to accounts or materials we need to do the work. Delays caused by late feedback may extend project timelines.

Confidentiality

We treat your organization's information as confidential. We will not share your internal documents, donor data, financial information, or strategic plans with anyone outside our team and approved contractors without your written permission, except as required by law.

Limitation of Liability

Brightstocking, LLC's total liability under these Terms will not exceed the amount you have paid for services in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost revenue or data.

Termination

Either party may terminate a service engagement with 30 days written notice unless otherwise specified in your signed agreement. If you terminate early, you are responsible for payment of work completed through the termination date.

Governing Law

These Terms are governed by the laws of the State of South Carolina. Any disputes will be resolved in the courts of Beaufort County, South Carolina.

Changes to These Terms

We may update these Terms from time to time. When we do, we will update the date at the top of this page. Continued use of our website or services after changes are posted means you accept the updated Terms.
